2507 FAIRBANKS RECORDING DISTRICT NOTICE OF DEFAULT AND ELECTION TO SELL 1. Default has been made by the maker being delinquent in the payment due under a certain Promissory Note dated October 26, 2007, in the amount of $80,700.00, and Home Equity Line of Credit Agreement and additional advance thereto, in the amount of $32,200, wherein Alice M. Bickford, now known as Alice M. Morgan is the maker and Mt. McKinley Bank is the lender. 2. The balance due on the above described note is in the sum of $66,978.00, plus interest from August 1, 2012, at the rate of 7% per annum, and other sums pursuant to the Deed of Trust given as security for said note including costs of sale. The balance due on the above described credit agreement is in the sum of $28,858.89, plus interest from August 1, 2012 at a rate of 6% per annum, and other sums pursuant to the Deed of Trust given as security for said agreement, including cost of sale. 3. Under the terms of the note and credit agreement, the unpaid balance shall become due and immediately payable at the lender’s option upon the delinquency of any installment payment. The monthly payment related to the note is four months in arrears and the credit agreement is three months in arrears. Mt. McKinley Bank exercises its option and declares the full unpaid balance of the note and credit agreement payable, and has so notified the maker thereof, and does hereby again notify the maker thereof. 4. Said note and credit agreement, described above are secured by a Deeds of Trust wherein Alice M. Bickford, n/k/a Alice M. Morgan, is the Trustor and Yukon Title Company is the Trustee, and Mt. McKinley Bank is the Beneficiary, which first Deed of Trust was recorded on October 31, 2007 as Instrument #2007-025409-0, and said second Deed of Trust was recorded on July 17, 2008 as Instrument #2008-014498-0; both records of the Fairbanks Recording District, Fourth Judicial District, State of Alaska. 5. The property that is the subject of said deeds of trust is situated in the Fairbanks Recording District, Fourth Judicial District, State of Alaska and more particularly described as: Lot 22 of Campus Acres Subdivision, according to the plat filed October 21, 2003 as Plat No. 2003-115; Records of the Fairbanks Recording District, Fourth Judicial District, State of Alaska. Physical Address: 2300 Maria Street, Fairbanks, AK 99709. 6. Default has arisen by Trustor’s failure to make payments required by the terms of the above-described Deeds of Trust. 7. If the default has arisen by failure to make payments required by the trust deed, the default may be cured and the sale terminated if: (1) payment of the sum in default, other than the principal that is not then due if default had not occurred, plus attorney and other foreclosure fees and costs actually incurred by the beneficiary and trustee due to the default, is made at any time before the sale date stated in the notice of default or to when the sale is postponed; or (2) a notice of default has been recorded two or more times previously under the same trust deed and the default has been previously cured, the trustee does not elect to refuse payment and continue the sale. 8. The Trustee hereby elects to sell said property for cash to satisfy the unpaid obligations. 9. The Trustee has complied with the bond requirements set forth in AS 34.20.125(a). All persons take note that the Trustee, Yukon Title Company, elects to sell the above-described property for non-payment of the above-described note and credit agreement that are secured by said previously described Deeds of Trust, and that such sale shall be on the 4th day of March 2013, at the hour of 10:00 a.m., in the indoor lobby of the Alaska State Court and Office Building, 101 Lacey Street, Fairbanks, Fourth Judicial District, State of Alaska.
